General Terms and Conditions
1. General
1.1. In these general terms and conditions of sale, we, IIP in Wichelen, are referred to as the SELLER. Our customer is referred to as the BUYER.
1.2. These terms and conditions apply to all agreements and offers between the SELLER and the BUYER.
2. Quotations
2.1. All prices quoted are exclusive of VAT unless otherwise indicated.
2.2. The SELLER reserves the right to revise prices at any time unless a contractual agreement has been made for a specific period.
2.3. The prices listed on the webshop and in brochures are compiled as carefully as possible. Should it later become apparent that an error has been made, the SELLER is entitled to correct these errors without being liable for damages in that regard.
3. Orders and Deliveries
3.1. All deliveries are made ex-works (from the factory), unless otherwise agreed.
3.2. Shipping costs are borne by the BUYER. For orders exceeding €500, delivery is free within Belgium, and for orders exceeding €1.700 within the Netherlands. For other countries, please contact us.
3.3. Variations in delivered quantities are permitted up to a maximum of 3%. The BUYER is obliged to accept any excess and cannot claim damages for any shortages within this margin.
3.4. Any defects upon delivery, such as shortages or damages, must be reported in writing to the SELLER within two weeks of delivery. The SELLER is not liable for complaints not made in time.
3.5. In the case of justified complaints, the SELLER will take back the goods and either replace them or issue a credit note.
4. Right of Withdrawal and Cancellation
4.1. Cancellation of an order is possible as long as the goods have not yet been shipped.
4.2. The consumer BUYER has the right to withdraw from the agreement without giving any reason within 14 days of receiving the goods. A written request must be submitted for this purpose.
- The goods must be returned in their original packaging.
- In such cases, it is sufficient to send an email to [email protected].
- Upon receipt of the return shipment, the full purchase amount, including the original shipping costs, will be refunded. The refund will be made using the same payment method and to the same account.
- The costs of returning the goods are borne by the BUYER.
4.3. Any damage to the packaging or soiled products will be charged to the BUYER.
5. Payment
5.1. The goods will be shipped after receipt of payment, unless otherwise agreed. If the BUYER wishes to collect the order personally, this is possible, and payment must be made in cash or via bank transfer, subject to the SELLER's approval.
5.2. If it has been agreed in writing that payment will occur after delivery, the invoice must be paid within 30 days of the invoice date without any deduction.
6. Applicable Law and Competent Court
6.1. All agreements between the SELLER and the BUYER are governed by Belgian law.
6.2. Any disputes will be exclusively submitted to the competent court in Dendermonde.
7. Liability
7.1. The SELLER is not liable for indirect damages, consequential damages, or business losses arising from the delivery of products.
8. Force Majeure
8.1. The SELLER is not liable for any damage resulting from force majeure situations, such as natural disasters, war, strikes, floods, or other circumstances beyond its control that prevent the fulfillment of the agreement.
9. Retention of Title
9.1. All delivered goods remain the property of the SELLER until full payment has been received from the BUYER.
10. Privacy and Data Protection
10.1. The SELLER processes personal data of the BUYER in accordance with applicable privacy legislation. See our privacy policy for more information.
11. Precedence of Terms
11.1. These general terms and conditions prevail over any terms and conditions of the BUYER unless expressly agreed otherwise in writing.
